The agreement you accept when opening the account: what you can do, what you can't and with what guarantees.
1. What these terms are
These terms are the agreement between Jordi Salord Font, owner of Petit Drac, and you, who use it. They govern access to the service and its use, and are completed by the legal notice and the privacy policy: the three documents form a single agreement.
They are accepted expressly when creating the account, by ticking the box on the sign-up form, and they are accepted again every time you sign in to an existing account. If you disagree with any of them, do not open an account and do not use the service.
For each account, the date these terms were accepted and the version published that day are stored. That is what makes it possible to know which text you accepted, and not another.
2. Who can open an account
You must be at least fourteen years old, in accordance with Article 7 of Spanish Organic Law 3/2018. Below that age, the consent of the holder of parental authority or guardianship is required.
The details you provide, your email and, if you wish, your name, must be truthful and up to date.
The account is personal and non-transferable. You are responsible for keeping your credentials safe and for notifying the owner if you suspect someone is using them.
On some copies of Petit Drac, sign-up is closed or limited to a guest list. The existence of the form does not oblige the owner to open an account for anyone.
3. How you sign in
There are two ways to sign in: with a Google account or with a Petit Drac email and password of your own. In the first case Google is the one that verifies your identity and your password never passes through here; in the second, the password is stored hashed, so it can be neither read nor recovered.
To create an account with a password, a code is sent to the email address given. That code serves only to verify that the mailbox is yours: without that check, anyone could register someone else's address.
4. What you can do with Petit Drac
You are granted a personal, free, non-exclusive and non-transferable right to use the application and its teaching content, for the sole purpose of studying Catalan on your own. That right lasts as long as your account is open.
You may copy sentences or explanations for your own notes. What you may not do is publish them as if they were yours or build another service with them.
5. What you can't do
Use the application for unlawful purposes, or try to damage it, overload it, alter how it works or access other accounts' data.
Share your account or hand your credentials to third parties.
Bulk-extract its content by automated means (scraping) or reuse it for commercial purposes without the owner's written permission.
Impersonate someone else when signing up or when communicating with the owner.
Bypass the security measures, the rate limits on sign-in attempts or any other technical limitation of the service.
The owner may suspend or cancel accounts that breach these terms, giving prior notice whenever possible and whenever the notice does not compromise the security of the service.
6. Price, plans and donations
Access to Petit Drac is free. The invitation to donate that appears in the application is voluntary: it is not a purchase, it entitles you to nothing and it unlocks nothing. Petit Drac is exactly as complete without donating.
If paid plans are ever offered, these rules will also apply:
Prices are stated in euros and include applicable taxes. They are shown, together with the details of what you are buying, before you confirm the order.
The contract is concluded electronically and in Spanish. You will receive confirmation by email, and you can request a copy of the contract at any time by writing to the owner.
Payment is handled by an external payment provider. The owner does not see, receive or store your card details.
Subscriptions renew for periods equal to the one purchased. You can cancel whenever you want and without penalty; cancellation takes effect at the end of the period already paid for, which you enjoy in full.
You can request an invoice for any amount paid.
7. Right of withdrawal
If you purchase a paid plan and you are a consumer, you have fourteen calendar days to withdraw from the contract without giving any reason and without penalty, in accordance with Article 102 of the consolidated text of the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007).
That right lapses, under Article 103(m) of the same law, in the case of digital content not supplied on a tangible medium whose performance has begun with your prior express consent and your acknowledgement that you thereby lose the right to withdraw. That consent will be requested expressly and separately at the time of purchase: if you do not give it, access begins when the fourteen days have elapsed.
To withdraw, it is enough to say so by email to hola@jordisalord.com, stating your name, the account and the purchase date. The refund is made within fourteen calendar days of the notice, using the same payment method you used.
8. Closing your account
You can stop using Petit Drac whenever you want. To have the account and progress deleted, it is enough to ask by email to hola@jordisalord.com from your account's address: they are deleted without undue delay, and the details are in the privacy policy.
The owner may stop providing the service, giving reasonable notice within the application so that you can request a copy of your progress before it happens.
9. Warranties and liability
The service is provided as is and without any guarantee of uninterrupted availability: there may be outages due to maintenance, hosting provider failure or force majeure. The teaching content is prepared with the greatest care, but there is no guarantee that it is free of errors or that using it will lead to passing any exam.
The full scope of this clause, including what you need to know about third-party material and about the browser's speech recognition, is in the legal notice. Nothing said here limits the rights that the law grants to consumers.
10. Changes to these terms
The owner may modify these terms to adapt them to changes in the law or in the service itself. The version in force is always the one published on this page, with its update date at the bottom. Substantial changes will be announced within the application; continuing to use Petit Drac after that notice means accepting them, and if you do not accept them you can close your account.
11. Applicable law and complaints
These terms are governed by Spanish law.
If you have a complaint, write first to hola@jordisalord.com: it is the fastest route and the owner undertakes to reply. If it is not resolved and you are a consumer, you can go to your local Municipal Consumer Information Office (OMIC) or the Consumer Arbitration Board that applies to you.
For any court dispute, if you are a consumer the courts of your place of residence will have jurisdiction. In all other cases, the parties submit to the courts and tribunals of Terrassa.
